What does the regulation say?
As the pandemic has changed the way we work and live, increasing attention has been paid to how companies handle their personal data. There are differences in interpretations of GDPR and whether we in the EU can use American cloud services and collaboration platforms and still comply with the regulatory requirements established by the enforcement of GDPR in 2018.
The Schrems 2 verdict in July 2020 declared Privacy Shield framework as invalid, making it illegal to share personal data with countries outside of EU/EEA region. Transfers of personal data to third countries (a country outside of EU/EEA region) may only take place if the country can guarantee a high level of data protection.
What does this actually mean?
If you as a customer are operating on servers owned by a non-EU company, regardless if the servers are placed within the EU, the authorities could have the right to access all sensitive information, even though a the authority in the country is the information owner. Potentially, this could not only lead to confidential data being revealed to unauthorized persons or parties, reducing credibility of the company, but also lead to protracted legal proceedings.
