What are the implications of the new Whistleblower Law?
On the 29th of Septmeber 2021, the Swedish Riksdag decided to adopt a new Whistleblower law. It extends the protection of people who report perceived malpractice, meaning that all companies and organizations with more than 50 employees and/or that operate in public sector are required to have an internal whistleblower function in place. The new law enters into force on 17 December 2021
What is the purpose of whistleblowing?
Whistleblowing means that a person with insight into a company, organization or authority sounds the alarm that any irregularities occur. Whistleblowers often have good insight into the business but are generally also in a position of dependence, which creates a great need for protection against reprisals. The purpose of whistleblowing is to detect serious malpractice in the workplace. The best way to do this is through a whistleblower service where employees can, completely anonymously, report irregularities via a third party. By having a whistleblower service in place, it increases the chances of detecting risks and take action early.
How does Compodium ensure autonymization of the whistleblower?
The law requires that the people who receive the whistleblower reports, communicate with, and give feedback to the whistleblower are independent and anonymous. If internal individuals are involved, there is a risk that independence and autonomy cannot be guaranteed.
To ensure the legal requirement for the reporting person to remain completely anonymous, Compodium has developed its service together with the law firm Kaiding, whom provides advice regarding the whistleblower law. The law firm Kaiding can also be an internal reporting channel for employers affected by the legislation. Kaiding’s lawyers receive the whistleblower report and ensure that the right measures are taken.
Changes to the Swedish Public Access and Secrecy Act
As the new Whistleblower law enters into force, changes to the Public Access and Secrecy Act will be made to protect the whistleblower’s identity in the public sector. The change entails that the identity of the whistleblower will no longer be available when whistleblower reports are requested as a public document.
